The social ills of gambling are no secret, which is why most types are heavily regulated or banned altogether in Virginia. But there are loopholes, and through them all kinds of operators are step-by-step trying to turn the commonwealth into a gambling center. Virginia's regulation, for example, doesn't appear to extend to online sweepstakes outlets, which have sprouted virtually unchecked across the region in recent months. The businesses, often posing as Internet cafes, draw customers willing to purchase a block of time. That access comes with credits or points that can be used in sweepstakes-style games, where users have an opportunity to win more points and redeem them for cash. The thrill of chance and the prospect of a big prize keep customers glued to their seats and forking out money. Owners insist the sweepstakes games aren't "real gambling," but that defense rings hollow. North Carolina officials felt so strongly about the sweepstakes cafes that they passed a law banning them entirely, effective Dec. 1. Several of those businesses, as The Pilot's Aaron Applegate reported last month, have since moved into Virginia, where Attorney General Ken Cuccinelli has opined that they appear to comply with current law. Even so, the legality of the games remains unclear, and authorities are investigating whether the businesses violate state gambling laws. In the meantime, the games are proliferating, turning Hampton Roads into a de facto center of online gambling. If that sounds familiar to Portsmouth's early experience with poker halls, it should. That business went unchallenged for so long that the city was in danger of becoming Virginia's poker capital without citizens or City Council members ever having taken a vote. Supporters of the sweepstakes games argue that the cafes are comparable to bingo halls. But even bingo is regulated by state law, which outlines restrictions on play, payment and prizes, among other aspects of the game. At the municipal level, an equally pressing issue involves where - and when - these sweepstakes cafes should open. City staff in Chesapeake is drafting a zoning amendment that would restrict their locations and hours. Without it, these businesses are free to draw customers 24 hours a day without regard for their neighbors. These are not imaginary concerns. As The Pilot's Marjon Rostami reported recently, residents in Chesapeake's South Norfolk community have complained to city officials that the sweepstakes cafes are threatening efforts to revitalize the neighborhood. Virginians have the right to fritter away their money. But before Virginia is covered in gambling halls, lawmakers in Richmond and municipal governments should make a conscious decision to do so.

Jeremy started gambling at school football and hockey pools when he was 11. At 16, he went to his first racetrack, fibbing to his parents about his whereabouts. "My first night at the race track was the greatest night I ever had. I loved the thrill, the rush and the excitement and I went back the next day and got hooked," said Jeremy, who's now in his mid-40s and requested anonymity. When his mom gave him $40 to buy a new pair of shoes, Jeremy walked into a store, tried on a pair of shoes and walked out without paying. "If I had $100, I would bet it. If I had $2 I would bet it and get the same thrill. I would beg, borrow and steal to gamble. When you're a compulsive gambler, getting money to gamble is all you care about," he said of his gambling addiction. During university, Jeremy played card games, went to casinos and bet with bookies on all types of sports. He cut classes and bet on anything he could. He worked part-time to pay debts. Eventually, he flunked out of school and got a full-time job in an attempt to get himself out of the hole. In 1990, at age 24, Jeremy wound up at his first Gamblers Anonymous meeting. He attended those meetings for more than 11 years. It was there he met his wife, made life-long friends and eventually got his life on track. Then one day in 2001, he had an itch to start playing the stock market. He stopped going to Gamblers Anonymous, started playing poker at casinos and online, placing bets with bookies and betting on sporting events. "There were highs when you won, but lows when you lost. It's not like I went out and bought stuff when I won. I kept trying to win to pay off what I owed to get even," Jeremy said. Jeremy said after a bad night losing at the racetrack, he thought about driving his car into the guardrail of the Gardiner Expressway to end his life. "I was totally hopeless and I thought if I turned the car to the right, I could end it," Jeremy recalled. "It was the worse seven years of my life. I was lying to my wife and kids. I stole from the business, borrowed from friends and family, maxed out credit cards, and refinanced the house twice," Jeremy added. "I wanted to stop gambling, but I couldn't. It's an illness. Finally, on Oct. 18, 2008, I got a call from my brother-in-law and he told me to take a photo of my wife and kids and he told me: 'The next time you bet, take a look at the photo because that's what you're betting away,' " Jeremy said. "That's when it hit me and I decided to stop." Jeremy has not gambled for two years. He's still paying off gambling debts and attends Gamblers Anonymous regularly. Dr. Nigel Turner, a scientist at the Centre for Addiction and Mental Health, said there are two types of gamblers: Ones who want the thrill and try to make their lives more exciting and those who are miserable and want to escape their plight. "Those who used to see gambling as excitement often lose so much money that they move to see gambling as the only possible way out of the financial mess they've made for themselves. They keep going to pay down their debt, but it takes a lot of losses before the wake-up occurs because they get into a cycle," added Turner. He said the occasional win drives them to continue and reinforces the message that it's essential they win to pay back borrowed money.

AHN News Staff Charlottetown, Prince Edward Island, Canada (AHN) – Prince Edward Island has joined the growing list of Canadian provinces in favor of the government running its own gambling website in a bid to hike revenues. PEI Finance Minister Wes Sheridan spoke in favor of following the examples of British Columbia, Ontario and Nova Scotia. Sheridan made the statement after PEI got an offer from the Atlantic Lottery Corporation to look into its Playsphere website to include online gambling. ALC estimated that PEI would earn $50 million a year by adding online gambling, but Sheridan said the province would ensure the site would be regulated and policed if it accept ALC’s offer. Playsphere offers only interactive games. PEI earned $14.7 million last year in lotto earnings, which was $3 million less from 2008. British Columbia made Canadian history by launching its own gambling portal, but hours after its roll out, Vancouver closed the website because of a security breach. After a few weeks of closure, BC’s gaming has resumed operations after the technical glitch was fixed. Ontario launched a consultation process to seek the province resident’s opinion on the matter and Nova Scotia is about to initiate a similar move. The long-running battle over state-run gambling monopolies in Nordic countries has heated up recently, with Sweden and Norway contemplating new measures to protect the state's grip on certain forms of online gambling. Taking a page from the US and Italian playbooks, both countries are moving closer to banning bank transactions to foreign poker sites and even blocking the sites themselves. That could spell trouble for the major international poker vendors, who have long viewed the Scandinavian market as one of the most lucrative outside the US and Britain. Swedes, Norwegians and Danes have been on the forefront of the poker craze for the last five years, with about 25% of the population estimated to play some form of the game. But after spending years challenging the Nordic monopolies in EU courts, the private betting companies are again crying foul and vowing not to lie down without a fight. 'Blocking websites is not something that belongs in a modern Swedish society in 2009,' said Unibet spokeswoman Inga Lundberg. Pontus Lindvall, the CEO of Betsson, is also striking a combative note and seems certain that new legal battles are on the horizon. 'It's like they're asking to end up in an EU court again,' he said. Sweden's poker monopoly At the heart of the Swedish uproar is a proposal that was presented in December by a government-appointed committee. The committee was charged with finding ways of modernising the country's gambling monopoly, which is based on decades-old laws and has struggled to keep up with the spread of online betting. Among the proposals given by Jan Nyren, a lawyer who headed the investigation, were two points that would radically change the Swedish market: 1) opening up sports betting for private companies, and 2) taking steps to give the state a total monopoly on online poker. The proposals are loosely based on the Italian system of giving licences to private companies to operate domestically while banning all foreign-based websites. Norway is moving in a similar direction, having already passed a law to block bank transfers to gambling sites, although the bill has yet to be enacted. The Swedish proposal, however, stands out as the most drastic when it comes to online poker. Unlike in Italy, international poker sites would not be allowed to apply for licences in Sweden, as Nyren's investigation classified all interactive online games as being the most addictive and dangerous for players. Therefore, the proposal says, online poker, bingo and other casino games should only be offered by Svenska Spel, the state-owned company that organises all betting and lottery games in Sweden. In contrast, Svenska Spel would have to completely drop its sports-betting arm, opening up the market for private companies to operate under licence. This would be a major victory for companies like Ladbrokes, Unibet and Betsson, who have worked for years to legally enter the Scandinavian markets. Betsson went so far as to openly defy the Swedish monopoly last year by opening a betting store in Stockholm, and was quickly taken to court by regulators. But even these companies - not to mention pure poker sites - are seething over the second part of the proposal, which essentially aims to give Svenska Spel's poker room a 100% share of the Swedish market. It would be done by banning bank transfers to foreign sites, and in some cases blocking the IP addresses of websites so they cannot be accessed from within Sweden. The proposal would also maintain the national casino operator Casino Cosmopol's monopoly on staging live tournaments and cash games, dashing efforts to legalise private poker clubs. A government decision on the Swedish gambling proposal is expected later this year, and major lobbying efforts are already in place from players and vendors alike to strike it down. Strong opposition Unsurprisingly, the proposal is running into strong resistance from all sides, including from Svenska Spel, which is reluctant to pull out of the sports-betting market. Spokesman Andreas Jansson said it would be better to keep the current system, but with tighter rules to make sure the current restrictions are not violated. 'It's good that they are trying to tighten things up and create order in the gambling market. The rules that exist are not being followed,' Jansson said. 'But experience shows that opening up the competition makes it harder to control gambling addiction.' Svenska Spel is also facing a major monetary loss, as the increased poker revenues are unlikely to make up for the lost sports-betting income. 'It's hard to estimate, but even if we get a monopoly on poker we would lose money,' said Jansson. Companies like Betsson are in the opposite situation. They would likely make millions on sports betting, but are not willing to part with their Swedish poker business and are up in arms over the attempt to block foreign IP addresses. '(The proposal) would quite possibly benefit us, but that's irrelevant,' said Pontus Lindvall. 'As a principle we don't like that they are carving things up like this. There is no reason for it. ... They're trying to take a major step backward. It's like saying that we want to boost the Swedish tourism industry, so we'll forbid people from going to Spain.' Lindvall also questioned the motivation for singling out interactive online games, saying the government is more interested in protecting its cash cows than preventing gambling addiction. 'They are tying themselves into knots trying to motivate it,' he said. 'They've grouped together all the games that they are making good money on today. It's an artificial separation that is very easy to see through.' Inga Lundberg of Unibet compared the proposal to a previous attempt in the 1980s to keep private broadcasters out of the Swedish TV market, where national broadcaster SVT used to be the only operator. 'If you had 30 TV channels available, and the government said you could only watch two of them, would you agree to that?' Lundberg said. 'The customers will win, and customers want freedom of choice.' Jansson also sees a bigger threat to Svenska Spel than just the loss of its sports-betting revenues. If one part of the gambling monopoly falls, it might be easier to crack other parts as well, he said. 'It could become difficult to justify why other parts of the market should have monopolies or regulations,' he said. 'It could difficult to argue for that. There will be those who will push for opening things up even more.' The market There is serious money at stake. Swedish residents spent nearly 41 billion kronor (around £3.4 billion) on gambling and betting within the country in 2008, with operators raking in 16.6 billion kronor (£1.3 billion) after paying back winnings. Added to that are the billions spent on foreign websites that the new proposals are designed to claw back. 'If we introduce licences and other players enter the market, then we have to close the Swedish border,' Nyren said when he presented the proposal to a packed press conference. 'These billions that are leaking out of the country will hopefully stay in Sweden.' On the poker side, Svenska Spel's online client has seen a steady growth in traffic since it opened in 2006, with an average of about 1,200 cash game players online at any time. The site's total rake has nearly doubled in three years - from 206 million kronor (around £16.2 million) in 2006 to 372 million kronor (£29.3 million) in 2008. Still, more Swedes are estimated to play on foreign sites than at Svenska Spel, meaning there is huge room for growth under a state monopoly. Jansson estimated that the rake could grow 'by a couple of hundred million' each year if Swedes are forced to play there. 'We haven't calculated exactly how poker would be affected, but it's reasonable to assume that we'll take a large share of the market,' said the Svenska Spel spokesman. 'But it depends on how serious [the government is] when it comes to blocking foreign sites, and how difficult they will make it to play elsewhere. But if they succeed with that, obviously we can take a rather large share. We are the biggest single operator in Sweden today, but there are still more people playing on foreign sites.' While the Scandinavian poker boom has slowed down in recent years, it is far from tapped out, said Lindvall. 'We are still adding thousands of new players every day,' said the Betsson boss. 'So somewhere, we are still winning. But we have definitely passed the apex of the poker development.' Challenges There is still widespread uncertainty over what kind of effect - if any - the online poker proposal would have on the Swedish poker market if it gets passed into law. Some critics say any measures to stop bank transfers are pointless since players can still deposit and withdraw money via sites like Neteller, but blocking IP addresses could cause a major headache for poker players. 'This is a very controversial issue,' said Jan Nyren. 'But if you look at what other countries have done, it's very practical.' It is also unclear whether Svenska Spel could handle a significant increase in poker traffic. The Swedish operator was left red-faced last year when its server crashed during the final stages of its national online championships because of the large number of spectators that logged on to watch the conclusion. With only three tables remaining, some of the players could no longer be dealt in because of technical difficulties, and Svenska Spel was finally forced to cancel the tournament and pay out winnings based on chipstacks. The blunder caused an uproar among players and highlighted some of the poker client's shortcomings compared to the major international sites. If Svenska Spel does indeed get a total online poker monopoly, Jansson said it would make sure the poker room is up to the task. 'We have to check very carefully that we have enough capacity,' he said. 'And we have to be ready to expand it if needed.' There are also deterrents for private companies when it comes to sports betting. The government has strict regulations on how much Svenska Spel can pay back in winnings to punters, which has given foreign websites a big advantage as they can offer better odds to players. But if the Swedish market is opened up, those regulations will remain, meaning gamblers will still have incentive to look elsewhere. Then there are the legal issues. Both Unibet and Betsson are convinced that a poker monopoly would violate EU laws, and are prepared for new court battles. 'We have always been a counterweight to the government when it comes to challenging the monopoly in EU courts, and we will continue to do so,' said Pontus Lindvall. With so much opposition to the proposal, the fate of online poker in Sweden remains unclear. But the recent developments are a clear sign of one thing: the Swedish government is not going to give up on its gambling monopoly in a hurry. 'We have our standard answer for when the monopoly will fall: in five years,' Lindvall said. 'But we were saying that five years ago as well, even eight years ago. We're starting to get tired of it. [The government is] proving to be more tenacious than we thought.'

The USA is a nation both in love and at war with the game of poker. On the one hand you have the heaving Amazon Room at the Rio Casino in Las Vegas during the World Series of Poker, and on the other you have the UIGEA, and Kentucky legislators attempting to seize control of a number of poker website domains. Turn left and poker is a national pastime and prime-time TV entertainment, turn right and it is the wicked work of the devil. But with sliding gaming revenues nationwide, a global recession and an increasing acceptance of the game as a mainstream leisure activity, how long can this Chinese wall remain standing? Bizarrely, it seems as if the wall could actually be strengthened with yet more actions in the new year. One source at a large poker company told IPB earlier this year that it would not be a surprise to see more action taken against online operators by the US Department of Justice. And there will likely be some additional fallout from the introduction of the UIGEA regulations by the banking industry next year. The final rule on the regulations aimed at preventing the transfer of money between US institutions and online gambling sites will come into effect on 19 January 2009. Some legal commentators have suggested the new regulations will have little effect. Individual transactions, such as those between a player and a site, are seemingly not covered, and few, if any online sites do business directly with US financial institutions, with the exception of payment processors. And it looks, in the interpretation of gambling law expert I. Nelson Rose, as if there will be little pressure on the payment processors to keep track of where 'individuals' are sending their money. However, it would be foolish to imagine the implementation of the UIGEA would lead to no action whatsoever, and there is sure to be some additional caution or wariness of banks dealing with companies who seemingly exist solely to enable online sites to process payments. Although it does appear as if nothing much has changed for the sites still operating in the US market, it would be dangerous to assume that the status quo is set to continue. If you look at the offshore sports-betting industry it is easy to see how the calm can often precede a violent storm. In March 2006 Calvin Ayre, the owner of online sports betting site Bodog.com, appeared on the front cover of Forbes magazine's Billionaires issue. Likewise his contemporary David Carruthers, chief executive of BetonSports.com, was riding high following a successful listing on the London Stock Exchange. And then in July of that year Carruthers was arrested and charged with conspiracy, racketeering and fraud in taking sports bets from US residents. Ayre did not make it onto the following year's billionaire list and the world of online sports betting was never the same again. That said, it is not to say a similar fate awaits online poker. Legally speaking, there does not appear to be a close parallel between online sports betting and the poker industry. The former is clearly outlawed by the Wire Act, and the latter doesn't sit entirely comfortably within the remits of gambling. Although this could be changed by PartyGaming founder Anurag Dikshit pleading guilty to breaking the Wire Act, alternative interpretations could place poker under the remit of skill games. It would certainly be a much harder case for US prosecutors to argue with a non-guilty plea. Indeed if there was a will among US legislators it is possible an argument could be made for poker being a special case separate from other forms of gambling. But perhaps just as realistic is a move to tentatively legislate all forms of online gaming, which with the combined weight of a global recession and sliding share prices for the Vegas giants looks more realistic now than ever. Online vs Offline A lot will depend on the position of the American Gaming Association - the trade association of the land-based casinos - which is a powerful lobbying body within the US. A spokeswoman for the American Gaming Association told the Washington Post that about half of casino companies would like to see internet gambling legalised, while the remaining firms either oppose it or favour a federal study of the internet's effect on compulsive gambling and other issues. The AGA told IPB it expects to have reached consensus in early 2009. The outspoken proponents of legalised online gambling within the AGA are MGM Mirage and Harrah's. MGM Mirage was one of the first major names to attempt to enter the online gambling space, launching an Isle of Man-licensed casino way back in 2001 called playmirage.com. The site was not open to US players and the MGM brand failed to appeal to a European audience and it closed its doors with a posted loss of $5 million in 2003. At the time the firm's chairman said the venture was in some ways a success as it 'proved critics wrong who said that online gaming could never be properly regulated.' It was an expensive way to prove a point, but it could prove a wise investment should the discussions on the feasibility of online gambling reach the US Congress. The other gaming group known to favour a legalised environment is the gaming giant Harrah's, owners of the World Series of Poker brand. Back in November 2007, the firm went on record as saying they were looking at taking the WSOP brand online in Europe. 'If you take a look at the legal landscape in continental Europe and the UK, there are countries where it's demonstrably legal and there's absolutely no encumbrance,' Harrah's chief executive Gary Loveman said at the time. 'Those are areas that are very attractive to us.' Harrah's' interest in online poker has been one of the longest courtships in the history of the sector. There were talks of it setting up a poker site with software firm WagerWorks back in 2005, but Harrah's is yet to dip its toe in the water and it is easy to see why. The success of the WSOP main event is driven by online qualifiers, as witnessed by the huge drop in attendance in the year following the passage of the UIGEA, and it would be hugely unwise to rock that boat. The World Poker Tour's attempt to set up an online poker room targeting European consumers was a dismal failure, not only running at a loss but causing rival sites to drop their sponsorship of the WPT. The lack of sites running satellites may well be why its attendance figures are falling while the PokerStars-backed EPT thrives. The World Poker Tour was for a short time the premier live poker brand in the world, but its position within the global marketplace has been slowly eroded by competitors both within and without the US. Parent company WPT Enterprises reported revenues of $2.8m for the third quarter of 2008, a 36% decline on the same period last year, widening the company's net loss during the period to $4.4m. This was mostly due to a drop in licensing fees after the show was dropped by the Travel Channel and picked up by the Game Show Network. But the main factor behind the firm's continued losses and sliding share price has been its inability to follow through on its vision of a worldwide TV audience and a successful online poker room. Outside of the US, with the exception of France, the show never achieved a mainstream audience. The WPT online poker room, meanwhile, was terminated in November 2008. The decision to open its own online poker room put the firm in direct competition with some of its key potential sponsors and supporters - the online poker sites. The closure of the room was almost immediately followed by an announcement that the WPT had signed a sponsorship deal with Full Tilt Poker for title sponsorship of the season seven broadcasts on the tour's new home at Fox Sports Network in the USA. The link between a US-based and publicly listed firm and an online operator still targeting the US market, albeit in its play-for-free '.net' format, is something that would have been unthinkable as little as a year ago. But there seems to be a gradual shift in momentum towards regulation and acceptance of poker as a mainstream leisure activity. There is a feeling that a case can be made for poker as a skill-based game, and there are two separate bills currently at committee stage in the US Congress that would officially put the game in a white operating environment. The nation's pastime yet may be given the chance to stand apart from other forms of gambling. Who would benefit? So who would be the big winners from online poker becoming regulated? One precedent to look at is the UK, where online poker is legal and there are several big brands that have tried to move into the space. Very few have had much success, with the likes of Virgin and Yahoo failing to gain much market share. Then there are the high-street bookmakers, who have attempted to leverage their high visibility and recognition among UK consumers. But even here there is no immediate cause for celebration by US gaming operators. Ladbrokes and William Hill by no means rule the UK poker market and the pure-play online poker sites such as PokerStars and PartyPoker are the dominant forces. In poker, liquidity is king. And there is no doubt who is wearing the crown at the start of 2009. Isle of Man-based giant PokerStars is believed to be making as much as $2 million a day profit and has grown to a size that eclipses PartyPoker in its heyday. The firm, believed to be majority owned by father and son team Isai and Mark Scheinberg, very nearly found itself in the same boat as PartyGaming, having taken a number of steps towards becoming a public company. It relocated its head office to the Isle of Man and appointed headhunters to recruit a CEO. But the process stalled and the firm found itself in the fortunate position of still being private when the UIGEA came to pass. While the likes of PartyPoker pulled out of the market, PokerStars remained open to US players and reaped the rewards. It is difficult to imagine PokerStars being welcomed with open arms by US regulators should there be a move towards regulation, but even if it was excluded its place would be taken by PartyPoker in a heartbeat. The firm's marketing expertise and financial muscle, as well as its existing brand, would make it a formidable force in a legal US poker market and it is likely the firm would become extremely attractive to a major US casino firm. However, there is another model that should strike fear into the heart of any online poker operator currently taking US customers and that is the one followed in Sweden. The Scandinavian nation has long been one of the major online poker markets in Europe, and its poker-hungry population was served by a number of online sites that advertised extensively in Sweden. Sites such as Unibet and Ladbrokes succeeded in gaining a large number of Swedish players, and this did not go unnoticed by the country's state-owned gambling monopoly. The government acted at first to restrict the sites' operation by banning advertising from foreign operators, but ultimately the national lottery operator Svenska Spel adopted the approach of 'if you can't beat them, join them'. Linking up with Swedish software firm Boss Media it launched the first officially licensed Swedish poker site, under the banner of promoting responsible gaming with strict time and wagering limits. The response was phenomenal. By the first quarter of 2007 it was taking a rake of €150,000 a day from online poker and this has boosted the company's profits for the period by 22%. It was far and away the country's largest poker operator after just over a year of operation. The letter of the law The winners from a regulated environment in the US would depend massively on the nature of the legislation. If licences were awarded strictly to large land-based operators and the message of 'social responsibility' was put to the forefront, it is easy to envisage a similar situation to Sweden, where private operators lost significant market share to Svenska Spel. But if the land of the free was more liberal with its licences, and operators such as PartyPoker were allowed to re-enter the market, it may not have the happy recession-busting ending the likes of Harrah's is hoping for. What seems clear is that cooperation between the established land-based casino operators and the online sector would ultimately benefit everyone. This is most likely to occur through a buyout of one of the listed poker operators, with PartyGaming seemingly the most likely acquisition target. But it could just as easily lead to partnerships and white labelling. If the two sides of the business can work together to put in place a legal framework that benefits everyone then there is a potential goldmine ready to be tapped. There are still millions of US poker players who are unwilling to play online, either through fear or ignorance, and to them the 'legal and licensed in the US' message might be a highly compelling one. For the moment the major players will have to wait and see what shakes out in terms of federal legislation, and the California poker initiative (see panel, p43). But make no mistake, everyone has a watching brief here and there are some mighty marketing muscles waiting to flex on all sides should that Chinese wall finally come crashing down. Steve Lipscomb, the chief executive of the World Poker Tour, told an industry audience at the World Poker Congress he felt Full Tilt Poker and PokerStars had played 'the most successful hand in the history of poker' by remaining in the US market following the UIGEA. But it will be far from the last played in this business, and 2009 could see them raised out of the game by those firms currently sitting back and waiting. This game is only just getting started.

'State lottery providers are anxious to explore new distribution channels, with US lottery sales from traditional outlets in decline,' observes report author Dr Windsor Holden. 'The upshot is that several lotteries are in the latter stages of discussion with mobile technology providers with a view to launching mobile lottery services in 2011.' In addition, argues the report, impending legislative changes in the US may herald an opportunity for mobile casino operators in the medium term. Online gaming web traffic up 11 percent, according to Media Metrix. Website, Internet, WSOP, Full Tilt Poker Online gambling sites have led the way in July, ranking high against other websites for highest gains in US web traffic for the month. The data, from comScore Media Metrix service, found that online gambling sites recorded a total of 13.4 million unique visitors in July, up 11 percent from the total for June. That gain could be partly attributed to interest in the World Series of Poker tournament, which "brought out the competitive side of Americans...prompting millions to visit online gambling sites to test their card-playing skills," comScore senior vice-president Jeff Hackett said. Poker Stars continued to lead all other gambling sites in the US in July, attracting 2.4 million visitors with an 8 percent rise from June, although Full Tilt Poker did its best to catch up, recording 2.3 million visitors on the back of a 14 percent rise. Other successful websites in July included Kingolotto Network with 2 million visitors, up 31 percent, and UltimateBet.com's online poker site with 1 million visitors, up 33 percent. A Greenfield lawyer who gambled away nearly $2.5 million of a client's money said at his sentencing Friday that playing the slots "was like the greatest drug there ever was," but that he hasn't gambled since his scheme was uncovered 22 months ago. Thomas H. Koch, 46, has been in treatment for a gambling addiction and attends Gamblers Anonymous meetings twice a week while working as a dishwasher. "Gambling isn't about the money," he told Circuit Judge David Hansher. "That's just the means to the end." Koch said he had tried to stop many times, but couldn't until he was caught. He said he's happy to be away from the casino, and he apologized to his client, family, friends, the court and the state bar. Prosecutors recommended four years, and Koch's attorney suggested a year in jail with release for work and therapy, and a stayed prison sentence to be served if Koch failed to meet conditions. Hansher credited Koch for quickly taking full responsibility for his crime once it was uncovered, for surrendering his law license and committing to treatment for his addiction. He agreed Koch probably didn't need prison to deter him from going back to the behaviors that have essentially ruined his life. But because of a need for general deterrence - a message to others that stealing so much money can't go unpunished - Hansher sentenced Koch to two years in prison, followed by four years of extended supervision. He must continue with Gamblers Anonymous and psychiatric treatment, and not enter any kind of gambling establishment anywhere, or gamble online. He also ordered Koch to pay $2,421,768.57 in restitution, even though Assistant District Attorney Kurt Benkley said Koch has no assets and likely will never pay the money back. Nearly two dozen people were in court to support Koch, and more than 30 submitted letters to the court. His wife said that even when he was gambling, he always was an outstanding, involved, caring father to their three sons, ages 7, 10 and 12. His sister said that in their family of eight children, they were expected to be self-sufficient and she was sad he felt he could never confide his problem to her. Since his arrest, the whole family's communication has improved, she said. "For the first time in his life, he seems calm," Kristin Koch said. Koch, a 1990 graduate of Marquette University Law School, operated his own law office at 3466 S. 13th St. Affiliated Computer Services, a Dallas-based company, works for medical insurers, checking to see whether their clients are suing to recover costs for their injuries when possible. ACS hired Koch in 2001 to pursue such cases in the Milwaukee area for ACS's insurance company clients. In 2007, a new litigation manager at ACS noticed Koch had about 360 open claims. When he failed to reply to her request for status updates, she found that about 270 had been settled, but that no proceeds had been forwarded to ACS. Company officials came to Milwaukee in October 2008, and Koch admitted his embezzling. Koch had told Hansher that in 2006 he signed up for Potawatomi's self-restriction list. He said he stayed away for two weeks, but when he returned no one turned him away, and that he collected on hundreds of jackpots after he was supposed to be banned. Hansher said Koch was not the first defendant he'd sentenced for stealing money that they lost at Potawatomi. Following the release of the Statistics Canada report, NDP deputy leader Deb Higgins repeated the call for a study to examine the effects of gambling on Saskatchewan residents and the extent the problem of addiction-based gambling exists in the province. 'We need to give this situation serious attention,' said Higgins. 'Behind those averages may lie patterns of problem gambling and gambling addictions that only a thorough study can reveal.' But Cheveldayoff said the Saskatchewan government has programs in place to monitor problem gambling. '(We) look at best practices model and have methods to monitor,' he said. But Craig Featherstone, Thorpe Recovery Centre executive director, said he wonders if the statistics are only based on tracked gambling, such as casino and lottery terminals. 'What I think they can't track is online gambling, which is becoming a bigger and bigger thing,' he said. 'There is online poker and online just about anything … there is all kinds of stuff.' While the Thorpe Recovery Centre hasn't seen a rise in Saskatchewan patients, Featherstone said the presence of online gambling is increasing on both sides of the border. 'It's an escape just like any other addiction,' he said. 'The difficulty with gambling is very quickly it affects so many people in their family because they are spending all the money. Some people are spending their life savings and mortgaging their house. There are pretty drastic effects that can happen from problem gambling.' Cheveldayoff said in recent years, Lloydminster residents have contacted the government about a possible casino in the area. 'Gaming is here to stay,' he said. Long-running dispute over legality of an innovative concept Nicholas Jenkins, the feisty lawyer and internet entrepreneur who has fought the Washington state government through the courts in defending his Betcha.com concept may have come to the end of the road. This week the Washington Supreme Court ruled that the founder of Betcha.coms unique proposition that betting was not gambling because losing players were not compelled to pay up still constituted illegal gambling. In a unanimous ruling, the court defined Betcha.com as an illegal bookie because it arranged bets and took a percentage of the action as a fee, reports Associated Press. The Bench said it did not have to decide whether optional payments by bettors would allow Betcha.com to technically escape the state's gambling restrictions. 'Under the statutory definition of bookmaking, it is immaterial whether or not Betcha users were engaged in gambling activity,' Justice Tom Chambers wrote for the court. With typical irreverence and humour, Jenkins wrote on his blog that the court's reasoning 'didn't pass the giggle test.' 'Never in a million years did I expect an opinion like this one,' Jenkins wrote. 'The court's error is so obvious that I wonder if a single justice even cracked our brief, let alone the Revised Code of Washington.' Washington state allows some forms of non-tribal gambling, including cardrooms that offer poker, blackjack and other games with relatively low stakes. Online gambling and bookmaking fees, however, are specifically outlawed in the state, with draconian criminal penalties for operators and players. Betcha.com allowed users to wager on just about anything - from sporting events, to political contests, to whether the moon would be full on a given night. Users couldn't bet more than $1,000 at any one time. Anyone wanting to offer or accept a bet had to transfer money into an account to back any losses, with the money held in escrow by Betcha.com. The company charged fees for offering or accepting bets, for proposing counteroffers, or for premium placement on the site. Bettors would submit claims after the event in question, but the losing bettor always had 72 hours to opt out of paying the debt. Failing to pay bets could negatively affect a user's reputation on the site, which was tracked with a number representing their 'honor rating.' The state Supreme Court ruling overturned an earlier state appeals court decision that Betcha.com hadn't engaged in gambling. Its decision affirmed the company possessed gambling records, a gross misdemeanor, and transmitted gambling information over the Internet, a lower-level felony.

The AGA considers the 2006 Unlawful Internet Gambling Enforcement Act (UIGEA) an unsuitable piece of legislation. Fahrenkopf criticized the lack of clarity in the UIGEA. He echoed Reid when he said that if they could get only poker out of the purview of the UIGEA they would be very satisfied. What came through in the interview was not an urgent desire to see online gaming become a reality but an acceptance of its inevitability. Therefore the priority of the AGA is to protect the offline interests of its member land casinos who have been in the doldrums since the economic turndown. The AGA is getting involved with online gaming legislation because it does not want the federal government to, intentionally or unintentionally, do something that harms the industry. One of the key issues in this regard is the proposed treatment of online gambling sites that have continued to illegally accept bets from players in the United States after the UIGEA was passed. The AGA is working to ensure that provisions are put in place that would prevent these operators from cashing in on the opportunity created by legalization of online gambling. Fahrenkopf said that he had spoken to legislators who say, 'So, you deny someone a license because they have been operating in violation of US law, that’s a penalty for what they did. But if you let them turn around and sell their assets, and make millions of dollars, they have benefited from violating the law, they shouldn’t allow that.'
